1. Introduction

This page sets out the terms and conditions on which you may use Petrologica.com and the content/services available on it, downloadable and otherwise (“Petrologica Content”).

We strongly recommend that you read these terms and conditions in their entirety. Our terms and conditions are only available in English.

In these terms we use the term “Petrologica.com” to refer to our website at Petrologica.com and our other mobile and online digital apps and services.

Except where we state otherwise in Section 8, references in these terms and conditions to “Petrologica” (or “we”, “us” or “our”) refer to the company operating Petrologica.com. See Section 7 below for our corporate information.

These terms apply in different ways depending on what type of user you are, as follows:

Registered users and personal subscribers: These terms apply to your use of Petrologica.com and all Petrologica Content irrespective of the delivery platform or device you use to access it. By accessing Petrologica.com you are agreeing to these terms and conditions. If you do not agree with the terms and conditions you should not use Petrologica.com or any Petrologica Content and should cancel any subscription in accordance with your cancellation rights (see Section 6 below). If you have any questions please contact admin@petrologica.com.

Users with access under an organisation’s subscription agreement: Your continued access is primarily governed by the subscription agreement of the organisation through which you are able to use Petrologica.com website. Sections 5 and 6 below are not applicable to such users. The remaining terms and conditions apply to your use of Petrologica.com website or any Petrologica Content. By accessing Petrologica.com you are agreeing to these terms and conditions. If you do not agree with these terms and conditions, then you should not use Petrologica.com or any Petrologica Content.

All users: PETROLOGICA may update these terms and conditions for legal or regulatory reasons, or to reflect changes in our services or business practices. We will provide notice of any significant changes in Section 11 below. You should regularly check Section 11 to see if any changes have been made. If you are a Petrologica.com subscriber, any changes to our terms and conditions will become effective from the date of your next payment following the change unless we notify you otherwise. If you are not a Petrologica.com subscriber, any changes will become effective as soon as we post them on Petrologica.com.

We may in exceptional circumstances cease to publish Petrologica.com, Petrologica Content or cease to provide subscription services. We will give you at least 90 days’ notice of this, if possible. If we do so, then we will have no further obligation to you, unless you are a personal subscriber in which case we will offer you a refund of the unexpired period of your paid subscription. See Section 6 for details.

2. Access and Use

Please read our Copyright Policy (Section 3) that summarises how you are allowed to use Petrologica Content and provides guidance on the types of use we do not permit without the purchase of additional licences from PETROLOGICA. You agree that you will comply with our Copyright Policy.

Organisations that may be using Petrologica Content without the appropriate permissions may approach us with a view to discussing the purchase of a licence to legitimise that use. Please write to admin@petrologica.com or use the Contact Us page on Petrologica.com.

The amount and types of Petrologica Content that you can view, and the platforms on which you can view Petrologica Content, depend on what type of user you are and what type of subscription (if any) you have. We can vary the access rights of registered users who are not accessing through a paid subscription at any time at our discretion.

3. Copyright Policy

This copyright policy sets out how users are permitted to use Petrologica Content and also explains the types of use that require the purchase of additional licences. Copyright law gives the copyright owner the exclusive right to control the use of copyright protected works. All of the material published on our website and other digital/wireless platforms is protected by copyright law and should only be used as set out in the Sections below. Use that is made without our permission may therefore infringe our copyright which can result in personal and corporate liability. Where we state below that something is not allowed or permitted, to do so is a breach of our terms and conditions, i.e. a breach of contract, and may also violate copyright law.

We reserve the right to change our copyright policy from time to time by publishing an updated policy on Petrologica.com, which shall become effective and replace any previous policy with effect from publication.

Ways in which Petrologica Content may be used: You may view our content for your personal use on any device that is compatible with Petrologica.com (this might be your PC/laptop, smartphone, tablet or other mobile device), and download and store (where applicable) our content on that device for your personal use. You may also download, store and use data or graphs/charts from our databases provided you have an appropriate subscription and use the download tools provided by us. You may also print single copies of articles and reports on paper for your personal use provided you do not distribute them or allow others to do so.

We also permit limited republishing and redistribution of Petrologica Content as set out below provided that this does not create a substitute for Petrologica’s own products or services.

We define a substitute as a product or service that reduces the need for users or other third parties to pay for Petrologica Content directly, or which creates revenue from Petrologica Content to the detriment of Petrologica’s own ability to generate revenues from that Content.

To help ensure your limited republishing and redistribution of Petrologica Content does not amount to a substitute, please ensure you limit the scope of your publication to:

  • the original PETROLOGICA headline with a link to the Petrologica Content, and the first 140 characters of an article/report; or
  • an extract no longer than 30 words provided you source PETROLOGICA as the author of any article from which you have derived a summary by way of an attribution, with a hypertext link from the word “Petrologica” to the original story published on Petrologica.com

Please note that these permissions do not extend to content, data or other material published by Petrologica that we licence from third parties (including stock exchange or other index providers) which you may not republish or redistribute.

Linking to Petrologica Content: If you would like to link to any page of Petrologica.com, please read and comply with all applicable laws and the guidelines set out below.

A site or service that links to any page of Petrologica.com:

  • may display the PETROLOGICA logo to indicate the source of the link; but
  • must not otherwise use any PETROLOGICA trademarks without permission, or use PETROLOGICA logos or trademarks to imply in any way that PETROLOGICA is endorsing products or services without prior agreement;
  • must not remove, distort or otherwise alter the proportions or appearance of the PETROLOGICA logo;
  • must not misrepresent its relationship with PETROLOGICA or present false information about PETROLOGICA ;
  • must not be a site or service that infringes any intellectual property or other right of any person or that otherwise does not comply with all relevant laws and regulations; and
  • must not be a site or service that contains content that could be construed as distasteful or offensive.

Ways in which Petrologica Content may not be used: Except as set out above, you may not copy Petrologica Content from Petrologica.com or any third party source of Petrologica Content and you may not republish or redistribute full text articles or any data, graphs or figures in any media, including on paper, websites, newsletters or intranets.

By way of example only, this means that without the appropriate license you cannot:

  • Copy, publish or redistribute full text articles, photographs, graphics, tables, data or images in any way;
  • Create derivative works from our content, unless you are creating summaries as described above or have been granted the appropriate license;
  • Photocopy or scan copies of articles;
  • Remove the copyright or trade mark notice from any copies of Petrologica Content;
  • Use spidering technology or other datamining technologies to search Petrologica.com;
  • Create a database in electronic or structured manual form by systematically and/or regularly downloading, caching, printing and storing all or any Petrologica content;
  • Frame, harvest or scrape Petrologica Content or otherwise access Petrologica Content for similar purposes;
  • Use or attempt to use Petrologica Content outside the parameters we set depending on what subscription you have;
  • Use or create summaries that promote or endorse any product or service without prior agreement.

You agree that if PETROLOGICA notifies you that it believes you are contravening this Copyright Policy, you shall immediately cease doing so and the relevant copyright permissions shall be regarded as having been withdrawn, unless/until PETROLOGICA reaches an agreement with you regarding your use of Petrologica Content.

4. Privacy Policy and Registration

All information received by us from your use of Petrologica.com will be used by PETROLOGICA in accordance with our Privacy Policy. Please read the following for details of how we may process your personal data.

On registration, you must provide PETROLOGICA with accurate, complete registration information as required and it is your responsibility to update and maintain changes to that information on the applicable Petrologica.com registration or subscription pages. PETROLOGICA is entitled to rely on any information you provide to us.

Each registration is for a single user only. On registration, you will choose a user name and password (“ID”). The email address that you provide on registration must correspond to a named email account and not a generic or shared email account. You are not allowed to share your ID or give access to Petrologica Content through your ID to anyone else. PETROLOGICA does not allow multiple users on a network or within an organization to use the same ID. If you share your ID, PETROLOGICA may cancel or suspend your access to Petrologica.com without further obligation to you. You may not create additional registration or subscription accounts for the benefit of others or with the aim of avoiding our use of IDs to control access to and use of Petrologica.com.

You are responsible for all use of Petrologica.com made by you or anyone else using your ID and for preventing unauthorised use of your ID. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID or any payment information, you must notify PETROLOGICA immediately by e-mailing us at admin@petrologica.com. We recommend that you do not select an obvious user password (such as your name) and that you change it regularly.

If you provide PETROLOGICA with an email address that will result in any messages PETROLOGICA may send you being sent to you via a network or device operated or owned by a third party (e.g. your employer) then you declare that you are entitled to receive those messages. You also agree that PETROLOGICA may stop sending messages to you without notifying you.

If you are a registered user of or subscriber to Petrologica.com then you may choose to use Petrologica.com’s “Remember me” log in feature that enables you to be logged in automatically to Petrologica.com whenever you visit Petrologica.com without having to manually log in each time. We recommend that you do not enable this feature on any computer that is or may be used by anyone other than you in order to prevent unauthorized access by third parties to both your subscription details and features of Petrologica.com personal to you.

5. Paid Access to Petrologica Content

Contract formation: PETROLOGICA endeavours to process your order promptly but cannot guarantee a specific time of product delivery. By submitting an order you are making an offer to us to buy the subscription(s) and/or product(s) in question. Your offer will only be accepted by us and a contract formed when we have successfully verified your personal details and taken full payment, at which point we will provide you with access to your purchase(s). This means that you do not have a 14 day right to cancel and that you are therefore not entitled to a refund if you change your mind after we have provided you with access to your purchase(s). PETROLOGICA reserves the right to reject any offer in its discretion, for any or no reason.

Payment details: When you make a purchase, you must provide us with complete and accurate payment information. By submitting payment details you promise that you are entitled to make the transaction in question using those payment details. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your access to your subscription(s) or product(s) in question. In suspicious circumstances we may contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties. If you are entitled to a refund under these terms and conditions we will credit that refund to the card or other payment method you used to submit payment, unless it has expired in which case we will contact you.

Pricing: The subscription or product price will be made clear to you before your purchase and may vary from time to time or by country. You agree to pay the fees at the rates notified to you at the time you purchase your subscription. For certain subscriptions you can take out either an annual or monthly (or other frequency we offer) payment plan. You can also take out any other fixed term or payment frequency that we may offer from time to time. Other content and services may only require a one-off payment. The currency in which your purchase is payable will be specified during the order process. Eligibility for any discounts is ascertained at the time of purchase and cannot be changed during the term of your initial subscription term. We will always tell you in advance of any increase in the price of your subscription and offer you an opportunity to cancel it if you do not wish to pay the new price.

Trial subscriptions: Where we provide a trial subscription, we will inform you of the full subscription price that is payable after the trial period. After the trial, your subscription will renew automatically at the full subscription price unless you cancel your subscription before the end of the trial. To cancel your subscription during the trial, please follow the simple cancellation instructions on your account page. We reserve the right to deny or cancel a trial subscription without notice for any or no reason.

Unless otherwise indicated, prices stated on our website are inclusive of any applicable value added tax (VAT) or other sales taxes. The breakdown of any applicable VAT payable with your order is indicated on the invoice you will receive with your purchase.

Pricing errors: If we incorrectly state a price to you whether online or otherwise, we are not obliged to provide you with the Petrologica Content at that price, even if we have mistakenly accepted your offer to buy, and we reserve the right to subsequently notify you of any pricing error. If we do this and your subscription has already started, you may cancel the subscription without any obligation to us and we will refund you any money you have paid us on a pro rata basis, at which point your subscription will end, or you may pay the correct price. If you refuse to exercise either of these choices then we may cancel your subscription and will refund you any money you have paid us on a pro rata basis. Where you have already received Petrologica Content on the basis of a one-off purchase via a download, you may keep that Content without extra payment. We will always act in good faith in determining whether a genuine pricing error has occurred.

Other costs: In addition to the Petrologica Content fee you are charged, certain banks and credit card issuers will charge a foreign transaction fee on transactions which take place abroad or in a foreign currency. The majority of payments for subscriptions we take by card are processed in the United Kingdom, therefore please check with your bank or credit card issuer to find out if such charges will be applied to you; PETROLOGICA is not responsible for any such charges. You are also responsible for paying any internet connection or telecommunications charges that you may incur by accessing Petrologica.com or Petrologica Content. For example, if you use any of our mobile services then your network operator may charge you for data or messaging services.

Datasets and downloadable content: Your right to access and use data downloaded or derived from any of our databases as set out in our Copyright Policy (Section 3) ceases at the time your relevant subscription ends. You agree to delete/destroy immediately and permanently any data you may have downloaded or otherwise derived from any of our databases once your subscription to that database has ceased. You also agree to provide written certification of compliance with this paragraph upon our request.

6. Renewals and Cancellations

Subscription renewals: At least 14 days before each renewal you will be sent a reminder notice stating the rate that will apply for the renewal period. Unless you notify us before the end of your subscription period that you no longer wish to receive it, your subscription will renew for another period. We will charge the subscription using the same card or other payment method that you previously used. No renewal is necessary for one-off purchases unless access is time-limited.

Subsequent cancellation of your subscription: Except as set out in the previous Section, you do not have any right to cancel your subscription or any part of it until the end of your then current subscription period. Although you may notify us of your intention to cancel at any time, such notice will only take effect at the end of your then current subscription period, and you will not receive a refund (except in the limited circumstances set out in these terms).

How to cancel: You may notify us of your wish to cancel your subscription by contacting our Customer Services team at admin@petrologica.com. Or alternatively, call +44(0)1206 823 295.

Cancellations by us: PETROLOGICA reserves the right to suspend or terminate your subscription or access to your account if you breach these terms and conditions, with or without notice and without further obligation to you. We may also suspend or terminate your subscription if we are prevented from providing services to you by circumstances beyond our control. If we terminate your subscription for any reason and/or permanently cease publishing Petrologica.com, Petrologica Content or cease to provide subscription services then, unless there are exceptional circumstances, we will provide you with a pro rata refund in accordance with the payment method you used. This means that we will refund you with any amounts that you have paid us in advance that relate to any remaining and unexpired period of your subscription. No refund will be given for one-off purchases. However, we will endeavour to provide you with digital copies of any reports you have previously purchased as part of a subscription or on a one-off basis.

Cancellation of your registration: If you are a registered user, but not a subscriber, then PETROLOGICA reserves the right to suspend or terminate your registration at any time, with or without notice and without further obligation to you. If you would like to cancel your registration then please contact our customer services team at admin@petrologica.com or using the telephone number set out above.

7. Who Your Contract is with

If you buy Petrologica Content via Petrologica.com, you will be contracting with Petrologica Limited (PETROLOGICA), whose principal place of business is at The Oak House, 10 Brook Street, Colchester CO7 9DS, United Kingdom.

8. Third Party Sites and Services

Petrologica.com may contain links to other Internet websites or online and mobile services provided by independent third parties, including websites of any advertisers and sponsors (what we call “Third Party Sites”), either directly or through frames. Third Party Sites may be co-branded with PETROLOGICA and so include PETROLOGICA’s logos and trademarks.

It is your decision whether you purchase or use any third party products or services made available on or via Third Party Sites and you should read Section 9 below carefully. Our Privacy Policy does not apply to Third Party Sites and the functions and services these may offer.

Petrologica.com may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on Petrologica.com complies with international and national law. PETROLOGICA is not responsible for any error or inaccuracy in advertising or sponsorship material.

Copyright in any software that is made available for download from Petrologica.com belongs to PETROLOGICA or its suppliers. Your use of the software is governed by the terms of any licence agreement that may accompany or be included with the software. Do not install or use any of this software unless you agree to such licence agreement. PETROLOGICA is not responsible for any technical or other issues that may happen if you download third party software.

9. Our Responsibilities to You

This Section is important and you should read it carefully. It makes clear to what extent, if any, PETROLOGICA accepts responsibility (liability) to you for your use of Petrologica.com or Petrologica Content or in respect of any third party products or services that we refer to or link to on Petrologica.com. Unless you are a personal subscriber to Petrologica.com, we accept no financial responsibility to you arising from your use of Petrologica.com or Petrologica Content. If you are a personal subscriber to Petrologica.com, we limit our financial responsibility to you arising from your use of Petrologica.com or Petrologica Content to the amount you paid for your subscription.

In no circumstances do we accept responsibility for your use of Third Party Sites or in respect of any Third Party Products. By Third Party Sites we mean websites, online or mobile services provided by third parties, including websites of advertisers and sponsors that may appear on Petrologica.com. By Third Party Products we mean products, functions or services provided by third parties.

Limitations of Petrologica Content:

Petrologica Content (including any information we publish regarding Third Party Products) is only for your general information purposes and is not intended to address your particular requirements. In particular, Petrologica Content and any other content provided by third parties and distributed by Petrologica.com does not constitute any form of advice, recommendation, representation, endorsement or arrangement by PETROLOGICA. It is not intended to be and should not be relied upon by users in making (or refraining from making) any specific investment, purchase, sale or other decisions. Appropriate independent advice should be obtained before making any such decision, such as from a qualified financial adviser.

Any agreements, transactions or other arrangements made between you and any third party named on (or linked to from) Petrologica.com are at your own responsibility and entered into at your own risk. Any information that you receive via Petrologica.com, whether or not it is classified as “real time”, may have stopped being current by the time it reaches you. Share price information may be rounded up/down and therefore may not be entirely accurate.

What we promise:

PETROLOGICA promises to develop and operate Petrologica.com with reasonable skill and care and we will use reasonable efforts to promptly remedy any faults of which we are aware.

What we do not promise:

PETROLOGICA does not provide any other promises or warranties about Petrologica.com and Petrologica Content. Petrologica.com and Petrologica Content are provided on an “as is” and “as available” basis. This means that PETROLOGICA does not make any promises in respect of Petrologica.com or the products, services and functions available on or through Petrologica.com or of the quality, completeness or accuracy of the information published on or linked to from Petrologica.com other than as expressly stated above.

The above disclaimers apply equally to your use of Petrologica.com and all Petrologica Content. Without limiting the above, PETROLOGICA is not liable for matters beyond its reasonable control. PETROLOGICA does not control third party communications networks (including your internet service provider), the internet, acts of god or the acts of third parties.

Our financial responsibility to you:

You agree that if we are in breach of these terms and conditions, we will only be responsible to you for any damages that you incur arising out of your use of Petrologica.com or Petrologica Content (to the extent that PETROLOGICA’s liability is not otherwise excluded by this Section 9) as follows:

If you incur any loss as a result of using Petrologica.com or any Petrologica Content outside the scope of these terms and conditions, PETROLOGICA accepts no responsibility (liability) to you for this.

You will be responsible for all claims, liabilities, damages, cost and expenses suffered or incurred as a result of your breach of these terms and conditions.

PETROLOGICA will only be responsible for loss or damage you suffer which is the reasonably foreseeable result of PETROLOGICA’s breach of a legal duty of care owed to you.

PETROLOGICA will not be responsible to you for any loss or damage suffered by your business, such as lost data, lost profits or any business interruption.

The limitations of liability in this Section apply for the benefit of PETROLOGICA, its affiliates, including those (if any) listed in Section 7 and all of their respective officers, directors, employees, agents or any company who we transfer our rights and obligations to in accordance with these terms and conditions.

To the full extent permitted by law you acknowledge and agree that our third party content and data suppliers have no liability whatsoever to you in respect of any of their data supplied to you as part of Petrologica Content.

10. Choice of Law and Jurisdiction

You agree that these terms and conditions will be subject to English law and that the courts of England will have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions.

11. General

You may not license or transfer any of your rights under these terms and conditions. We may transfer any of our rights or obligations under these terms and conditions but if we do so we will ensure that any company to whom we transfer our rights or obligations will continue to honour your rights under them.

If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect.

Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.

These terms and conditions constitute the entire agreement between you and PETROLOGICA relating to your use of Petrologica.com, PETROLOGICA’s mobile and other online services, and the Petrologica Content.

All Petrologica Content belongs to PETROLOGICA or its licensors who own all intellectual property rights (including copyright and database rights) in Petrologica Content and any selection or arrangement of Petrologica Content. No intellectual property rights in any Petrologica Content are transferred to you. You are permitted to use Petrologica Content only as set out in our Copyright Policy.
